Welcome to BeReal!

Our mission is to create services and technologies that allow you to live your real life and share that reality with your real friends.

To achieve this, we want to be very clear about what it means to be part of the BeReal community. We want you to know what you can expect from us, what we expect from you and how, together, we can improve BeReal for you and your friends.

To do this, we have created these terms of service ("terms"), our Privacy Policy and Community Standards (together, the "user agreement"). In the user agreement, certain words have specific meanings and must be interpreted in the same way, wherever they are used. If something is not clear, or if you do not understand what we are saying, please do not hesitate to contact us. Our goal is to maximize transparency and understanding of how BeReal works.

If you think it is difficult to read all of this, imagine having to write it! But we wrote it for you because it is important to you and to us. We therefore invite you to read it.

If you do not wish to read or accept the terms of service, do not use our services, but if you use our services, you agree to be bound by the terms of service.


1. Who can use our services?

Our services refer to all aspects of the BeReal mobile applications, our websites and the software and systems that power the applications and our website.

ChatGPT is cool but our services must not be used by AIs or bots. To use our services, you must be a REAL human (because feelings matter):

  • who is at least 13 years old. Depending on where you live, if you have not reached the age of consent in your country, a parent or guardian may also need to give their consent for you to use our services; or

  • who has the legal authority to create an account on behalf of another person, a company, an organisation, a government or another legal entity, if you are not creating an account for yourself.

All references to "you" and "your" in the user agreement mean both you, the end user and/or, for accounts created on behalf of another person, a company, an organisation, a government or another legal entity, the person who has the legal authority to create and/or operate the account.


2. Data protection and privacy

Our Privacy Policy describes the information you share with us, when it is shared and how we process it when you use our services. By using our services, you understand and agree that we must collect, use, store, process, share and transfer this information in the countries where we operate our services and to the partners who help us provide our services.

2.1 Updating your phone number

You are required to update your phone number immediately after any change to your contact details. Keeping your phone number up to date is essential for account verification, security and data protection reasons. To do this, you must use the in-app flow during login or contact us and provide the following information:

  • Your old phone number (including country code);

  • Your new phone number (including country code);

  • The BeReal username associated with your account;

  • Your date of birth.

BeReal cannot be held responsible for the consequences, including loss of access to your account, resulting from failure to update your phone number.


3. BeReal SMS Communications

By creating a BeReal account, accepting these terms and providing your phone number, you agree to receive certain SMS messages from BeReal at the number provided. Message frequency may vary and your mobile carrier's messaging or data rates may apply. BeReal will send you SMS messages related to your account and the execution of these terms, such as security alerts, service interruption or maintenance notifications, information relating to the deletion of your account, etc.

Promotional SMS. BeReal may occasionally send you promotional SMS messages, for example to inform you of special events or exclusive offers. By accepting these communications, you understand that they may be sent to you at any time, including outside quiet hours or local restriction periods, to the extent permitted by law. These messages may be sent through an automated system or any other broadcasting technology.

Managing your preferences. You can unsubscribe from promotional SMS at any time by replying "STOP" to the SMS. For assistance, contact us at dpo@bere.al. Choosing to unsubscribe to promotional SMS will not affect your access to the Application or your ability to use our services.

4. Content

Nobody likes people who steal content or disrespect others. Do not be that person. Be authentic. Be kind. Be respectful. Be yourself. Be real.

Content means profile pictures, photos, videos, RealMojis, emojis, captions, comments or messages shared through our services.

You are responsible for the content you share through our services, including ensuring that you have the right to use that content and that it complies with laws, rules, regulations and the user agreement.

If you share content that you do not have the right to use or that violates laws, rules, regulations or the user agreement, we have the right to remove it and we will.

We do not tolerate harassment, bullying, defamation, threats, hate content, child sexual exploitation, sexual abuse, promotion of suicide or self-harm, intellectual property theft or other illegal activities. For more information, see our Community Standards which are part of the user agreement.

You own the content you share through our services and grant BeReal a licence to use the content under the following conditions:

  • Friends-only Content: refers to content you have shared only with your friends on BeReal. On a voluntary basis, some people may choose to share their friends-only content with BeReal so that it can be used for communication, commerce and marketing purposes. If you decide to do so, you will need to grant BeReal a licence to use your Friends-only Content.

  • Globally Shared Content: refers to content you have shared with everyone on BeReal. In exchange for using our services, you grant us a worldwide, non-exclusive, royalty-free and sublicensable licence to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute the content you share globally in any media or distribution methods. This licence authorises us to make your globally shared content available to the rest of the world and to allow others to do the same. These additional uses are made without any compensation paid with respect to Globally Shared Content, as your use of our services is hereby accepted as sufficient compensation.


5. Content moderation and reporting

We want our services to be a place where people can express themselves while feeling safe.

5.1. Content moderation

BeReal uses a combination of automated tools and human review to moderate content on its services. Content is assessed against applicable law and our Community Standards.

Automated detection tools are used to identify certain categories of manifestly illegal content, including child sexual abuse material (CSAM). All reports submitted by users and authorities are reviewed by trained human moderators, who assess the reported content against applicable laws and our Community Standards. 5.2. Reporting content

If you encounter content that you believe is illegal under applicable law, or that violates our Community Standards, you can report it to us through the reporting feature in the Application or through the dedicated form on our website. You do not need a BeReal account to submit a report through the web form.

When submitting a report, you will be asked to explain why you consider the content to be illegal or in violation of our Community Standards.

If you are located in the European Union, you will receive an acknowledgment of receipt of your report. We will notify you of the outcome of your report and the reasons for our decision.


6. Termination of Services — Content Restrictions, Account Suspension and Termination

6.1. Termination by you. You can delete your BeReal account at any time through the Application settings by selecting the account deletion option. This results in the permanent deletion of the profile and content associated with your account, in accordance with our Privacy Policy.

6.2. Restrictions, suspension and termination by BeReal. BeReal will act in a diligent, objective and proportionate manner, with due regard to your rights and legitimate interests, including your freedom of expression. BeReal applies a graduated enforcement approach. Depending on the nature and severity of the violation, and taking into account all relevant circumstances (including whether the violation is a first occurrence), we may:

  • remove the content;

  • permanently suspend your account; or

  • delete your account.

Repeated violations will result in increasingly serious restrictions. Severe violations, including CSAM or other manifestly illegal content, will result in immediate and permanent termination on a first occurrence. Any permanent termination results in a ban from creating a new account.

Specific provisions for users located in the European Union

Sections 6.3 to 6.6 implement rights granted by Regulation (EU) 2022/2065 on a Single Market for Digital Services (the "Digital Services Act"). They apply only if you are located in the European Union. If you are located outside the European Union, you can contest any decision taken under Section 6.2 by contacting our customer support.

6.3. Statement of reasons. Whenever BeReal takes action against your content or your account, you will be given access to a clear and specific statement of reasons, including: the nature of the restriction applied, its duration, and its territorial scope; the facts and circumstances relied upon; whether the decision was made by, or with the assistance of, automated tools; the legal ground or specific provision of our terms or Community Standards on which the decision is based; and information on the redress options available under Sections 6.5 and 6.6.

6.4. Notification to affected users. Where BeReal takes action on the basis of a report submitted, the reporting user will also be informed of the decision and the reasons for it.

6.5. Internal complaint-handling system. If you disagree with any decision, you may submit a complaint free of charge through our internal complaint-handling system within six (6) months of being informed of the decision. To do so, send an email to appeal@bereal.com stating your username, the case reference set out in the decision, and the content concerned. Your complaint will be reviewed by qualified staff who were not involved in the initial decision. We will inform you of the outcome by email without undue delay and will provide the reasons for our decision, together with information on the redress options available. 6.6. Out-of-court dispute settlement and judicial redress. If you are not satisfied with the outcome of a complaint, you may refer the matter to a certified out-of-court dispute settlement body under Article 21 of the Digital Services Act. The European Commission publishes the list of certified bodies at https://digital-strategy.ec.europa.eu/en/policies/dsa-out-court-dispute-settlement. You are not required to use the internal complaint-handling system before referring a dispute to such a body. You also retain the right to seek judicial redress before the courts of any EU Member State, at any stage.

6.7. Account deletion for inactivity. In accordance with our legal data protection obligations, BeReal reserves the right to permanently delete your account in the event of prolonged inactivity. The inactivity period is calculated from the date of your last login to the Application. Your account may be deleted after three (3) years of continuous inactivity if you are located in the United States, or after two (2) years of continuous inactivity if you are located in Europe or any other jurisdiction outside the United States. BeReal may send you a prior SMS notification before the scheduled deletion, giving you the opportunity to log in to keep your account active.

6.8. Effects of termination. Upon termination, suspension or deletion of your account, your right to access and use our Services ends immediately. Notwithstanding the closure of your account, the provisions of these terms which, by their nature, are intended to survive (including intellectual property, limitations of liability and applicable law) shall remain in full force and effect.


7. Licence to use our services

Our services are protected by copyright, trademarks, trade secrets and other laws worldwide. Nothing in the user agreement gives you the right to use the BeReal name or any of BeReal's trademarks, logos, domain names, other distinctive brand features and other proprietary rights.

During the period of your use of our services, BeReal grants you a personal, worldwide, royalty-free, non-transferable and non-exclusive licence to use the software provided to you as part of our services. This licence is for the sole purpose of enabling you to use and enjoy our services in a manner consistent with the User Agreement. This licence ends when you stop using our services.

BeReal is free to use any feedback, comments or suggestions you may provide regarding our services.


8. In-app Purchases

"No Ads" subscription

BeReal offers a "No Ads" paid subscription, currently available to users located in the United States, allowing the removal of all advertisements shown in the Application. BeReal reserves the right to extend this offer to other markets.

The subscription is taken out and managed by the relevant app store (Apple App Store or Google Play Store).

BeReal reserves the right to modify the price of the "No Ads" subscription at any time. In the event of a price change, users will be notified before the new pricing takes effect.


9. Limitation of liability

By using our services, you agree that the liability of BeReal, its affiliates, related companies, officers, directors, employees, agents, representatives, partners and licensors is limited to the maximum extent permitted in your country of residence.


10. Applicable law and jurisdiction

To the extent these terms allow you or BeReal to initiate litigation before a court, you and BeReal consent to the exclusive jurisdiction of the courts of Paris and French law. You and BeReal agree that all claims and disputes (whether contractual or otherwise), arising from or related to the terms or the User Agreement, shall be submitted exclusively to the courts of Paris, France, and that such disputes shall be governed by French law, unless prohibited by the laws of the country in which you reside.


11. General provisions

BeReal may update the user agreement at any time. If we make an update that impacts the rights or obligations of either party, we will notify you within a reasonable time before the update takes effect, unless the update is required for security or legal compliance reasons. If you continue to use our services after the effective date, you accept the updated user agreement. If you do not wish to accept it, you must stop using our services.

If any part of these terms or the user agreement is found to be unenforceable, all other provisions will remain applicable.

The User Agreement is between you and BeReal SAS, whose registered office is located at 59 rue Jean-Jacques Rousseau, 75001 Paris, FRANCE, and which is registered under number 881 079 685 in the Paris Trade and Companies Register.
